Agenda is focus on discussing trends and insights of the Latin American payment ecosystem. It is the policy of Fiserv to comply fully with the antitrust laws.
This Forum is not a space to engage in any antitrust activity. In such sense all attendees should bear in mind that the antitrust laws are concerned not with preventing discussions and meetings among potential competitors, but with behaviors and or discussions/agreements that may unreasonably restrict competition among competitors.
Considering that the existence of unlawful agreements may be inferred from circumstantial evidence, the following topics may carry antitrust risks and must be avoided:
- Price-fixing agreements: any agreement among competitors to raise, lower, or stabilize prices is unlawful even if the price agreed upon is reasonable or beneficial to consumers and even if the agreement is never put into effect;
- The possibility or desirability of competitors’ limiting their sales of any product in any geographic area;
- Allocation or division of customers or territories among competing retailers;
- Efforts to influence suppliers’ prices;
- What constitutes a “fair” profit margin;
- Price lists or procedures for coordinating price changes.
